Terms of use
These terms govern the use of the Flam application and of the site that presents it. By using them, you accept these terms.
1. Who publishes Flam
- MAMMATCHA, SARL
- 2 chemin des Fades, 33133 Galgon, France
- SIREN 938 630 449
- Contact: flam@99m.fr
2. What Flam does, and what it does not
Flam is a remote control application for pellet stoves. It does not communicate directly with your stove: it addresses the manufacturer's online service, using the credentials you supply, exactly as the manufacturer's own application would.
Flam is independent. The publisher is neither mandated, nor endorsed, nor paid by any stove manufacturer or connectivity provider. Flam replaces neither your appliance's warranty, nor its installation by a qualified professional, nor its statutory servicing.
3. Safety — please read
Flam allows you to remotely light and stop a combustion appliance. That carries obligations which remain yours, and which the application cannot assume on your behalf.
You undertake to:
- only remotely control a stove that is installed in accordance with good practice and applicable regulation, by a qualified professional;
- keep the appliance serviced and swept as required by law;
- keep a working carbon monoxide detector in the property;
- make sure no flammable object is near the stove before any remote ignition;
- not use remote control if the appliance is faulty, being worked on, out of order, or if you have any doubt about its condition;
- not let an uninformed third party use your account.
The publisher cannot check the condition of your appliance, know whether an object has been placed on it, or detect a fault the stove does not report itself.
4. Availability
Flam depends on two things outside the publisher's control: the online service of your stove's manufacturer, and the network connection of the stove and of your phone. An interruption to either makes control impossible, and the publisher cannot remedy it.
The publisher therefore gives no guarantee of continuous availability, and no guarantee that a command sent will be carried out. Do not use Flam as the sole means of heating a place where a failure would have serious consequences.
Automatic features (Flam Pilot, Eco+) may additionally be suspended by the application itself when it detects an abnormal situation — an implausible sensor reading, repeated ignitions, or a daily ceiling reached.
5. Your account
Full access requires an account, created with an email address or via Apple or Google. You are responsible for keeping your credentials confidential and for actions taken from your account.
You must be at least 16. You may delete your account at any time from the application; the procedure is described on the Delete your account page.
6. What is free
Basic control — lighting, stopping, setting the target temperature and power level, checking status — together with the full weekly schedule and switching on the stove's eco mode, is free and will remain so.
7. The Flam+ subscription
Flam+ adds close monitoring of the stove, detailed statistics and the Flam Pilot and Eco+ automations.
Price: 2,99 € per month or 19,99 € per year in France. The applicable price is the one shown by your store at the time of purchase, in your currency and according to your country.
Trial: 10 days, with no payment card. At the end of the trial nothing is charged and the application simply reverts to the free version.
Seller: the subscription is sold by Apple or Google, depending on the platform used. The publisher does not collect the payment directly, has access to no banking data, and does not issue the invoice.
Renewal and cancellation: the subscription renews automatically unless cancelled at least 24 hours before the end of the current period. Cancellation is carried out in your phone's settings, subscriptions section. The publisher cannot cancel on your behalf.
Refunds: these fall exclusively under Apple's or Google's terms. Please contact them.
Right of withdrawal: since the subscription is sold by Apple or Google, any right of withdrawal is exercised with them, under their terms. The 10-day free trial also lets you try Flam+ before paying anything.
Price changes: an increase never applies to a period already paid for. You are informed before it takes effect and may cancel.
If the paid features become durably unavailable through the publisher's doing, you may cancel; financial remedies go through your store.
8. Fair use
You undertake not to attempt to access other people's accounts, not to circumvent the limitations of the free version, not to place an abnormal load on the servers, not to decompile the application beyond what the law permits, and not to control a stove without its owner's authorisation.
The publisher may suspend an account that endangers the security of the service or of other users, after notice save in an emergency.
9. Intellectual property
Flam, its name, logo, interface and code remain the publisher's property. Using the application grants you a personal, non-exclusive and non-transferable right of use — nothing more.
10. Liability
The publisher is liable for damage arising from a breach of its obligations, under the general law.
It cannot, however, be held liable for damage arising from:
- improper installation, servicing or use of your stove;
- a failure of the manufacturer's online service or of your connection;
- a fault in your appliance or its connectivity module;
- your failure to observe the undertakings in article 3.
In accordance with French law, nothing in these terms limits the publisher's liability in case of wilful misconduct, gross negligence, or personal injury.
11. Personal data
The processing of your data is described in the privacy policy, which forms an integral part of these terms.
12. Changes to these terms
The publisher may amend these terms. Any substantial change will be notified to you in the application before it takes effect. If you do not accept it, you must stop using Flam and, where applicable, cancel your subscription.
13. Governing law and disputes
These terms are governed by French law.
In case of difficulty, write first to flam@99m.fr.
Failing an amicable settlement, the French courts have jurisdiction. If you are a consumer, you retain the right to bring proceedings before the courts of your place of residence, and the mandatory provisions of the law of your country of residence within the European Union continue to apply to you.
Should any provision of these terms be held invalid, the others remain applicable.
